End User License Agreement (EULA)
IMPORTANT NOTICE: Please read all terms of this End User License Agreement (???Agreement???¡ì?¨¨) carefully. By downloading, installing, activating, or using RippleTone products in any way (the ???Software???¡ì?¨¨ or ???Sample Library???¡ì?¨¨), you acknowledge that you agree to be bound by all terms of this Agreement. If you do not agree to all terms of this Agreement, do not use this product and immediately delete all downloaded files.
1. Grant of License
Subject to your full compliance with this Agreement, the website (???Licensor???¡ì?¨¨) grants you a limited, non-exclusive, non-transferable, and non-sublicensable perpetual license to install and use the Sample Library on up to three (3) personal computers, solely for your personal or commercial music production projects.
2. Ownership
All intellectual property rights and ownership of the Sample Library?aincluding but not limited to all audio samples, recordings, programming code, scripts, graphics, interface design, documentation, and related content?aremain the property of the Licensor and its licensors. This Agreement does not sell the product to you; you are only granted usage rights as defined herein. The Software is protected by copyright laws and international treaties.
3. Prohibited Actions
You expressly agree not to engage in any of the following actions:
Prohibited Transfer:
You may not transfer, lend, lease, share, or otherwise provide the product, your account access, or any required serial numbers or license files to any third party.
Prohibited Resale:
You may not resell, distribute, sublicense, or otherwise commercially transfer the product in any form (including but not limited to standalone resale, bundled resale, or inclusion in a collection). Individual purchasers have no right to ???resell???¡ì?¨¨ their usage license.
Reverse Engineering Prohibited:
You may not decompile, reverse engineer, disassemble, or otherwise attempt to access the source code of the product.
Distribution Prohibited:
You may not copy, modify, create derivative works from, distribute, publicly release, upload, or use any part of the product (including but not limited to samples, presets, or scripts) in any form of sample library or sound source product.
Multi-Device Restrictions:
You may not install or use the product on more than one computer simultaneously (unless you have purchased a multi-user license explicitly authorizing such use).
4. Limitation of Liability
To the maximum extent permitted by applicable law, the Licensor disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Under no circumstances shall the Licensor be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, loss of profits, or business interruption) arising from the use or inability to use the product.
5. Termination
If you breach any term of this Agreement, the license will automatically and immediately terminate without further notice. Upon termination, you must promptly destroy and permanently delete all installed copies, backup files, and related license information. We reserve all legal rights to seek damages caused by your breach.
6. Technical Measures & Compliance Verification
We may use technical measures (such as serial number activation and online license verification) to manage license compliance. You agree that we may take reasonable steps to verify compliance. If we detect any violation of this Agreement?asuch as simultaneous use of the same license on multiple devices or different IP addresses?awe reserve the right to permanently disable the license without refund.
7. Refund Policy
Sales of this product are governed by our separate Return & Refund Policy. Please note that once you download or access the product files, refunds are not provided except under the limited exceptions explicitly described in the Return & Refund Policy. Any refund, once issued, immediately terminates the license granted to you under this Agreement.
8. Miscellaneous
Governing Law:
This Agreement is governed by the laws of the country/region where your purchase was made, as specified on the website.
Amendments:
We reserve the right to modify this Agreement at any time. Updated versions will be posted on the website, and you are responsible for reviewing them periodically.
Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
